Clovis NM – Ninth Judicial District Attorney, Andrea Reeb, announced that on January 24, 2019, Brandon Barron, age 29, of Albuquerque, NM, was sentenced to three years in prison for Criminal Sexual Penetration, a third degree felony. Barron was found guilty by a Curry County jury on November 1, 2018.
In March of 2017, the victim reported that a Kirby Vacuum salesman had sexually assaulted her in her home. A sexual assault exam showed injuries consistent with the assault and DNA evidence showed the defendant was the perpetrator.
The Honorable Fred Van Soelen presided over the sentencing hearing. "I think it's ridiculous that our legislature has chosen three years as the maximum sentence for this crime. That is the break you are getting," he said during the sentencing hearing on Thursday. The court pointed out that Barron had shown a lack of remorse and that this violation "strikes at a person’s right to feel safe in their homes." The Court also sentenced Barron to register as a lifetime sex offender and upon release from prison to serve sex offender parole for 5 – 20 years.
Brian Scott Stover, Chief Deputy District Attorney and Arwen Gaddis, Assistant District Attorney, prosecuted the case for the State. Barron was represented by Criminal Defense Attorney, Richard Valdez, of Albuquerque, NM.
