Clovis, NM – Ninth Judicial District Attorney, Andrea Reeb, announced that today a Curry County jury found Xavier Loving, age 25, of Clovis, guilty of Shooting at an Occupied Dwelling, Aggravated Assault with a Deadly Weapon, and Felon in Possession of a Firearm.
On August 14th, 2017, Loving walked past his neighbor’s house and shouted threats at him. When his neighbor came outside, Loving shot a single round at his neighbor, missed him, hitting the house while the victim’s four year old daughter slept inside. No one was injured. Loving had been convicted of numerous felonies in the past ten years, and was prohibited from carrying a firearm.
The Honorable Fred Van Soelen presided over the one-day trial and ordered that sentencing be held at a later date. Loving faces up to 16 and one-half years in the New Mexico Department of Corrections. This includes a four year enhancement for prior felony convictions. Loving is also pending trial in January on a charge of Aggravated Fleeing a Law Enforcement Officer.
