Clovis NM – Ninth Judicial District Attorney, Andrea Reeb, announced that today, Joshua Martinez, age 34, of Clovis, was found guilty by a Curry County jury of Aggravated Battery on a Household Member with a Deadly Weapon, a third degree felony; Felon in Possession of a Firearm, a fourth degree felony; and Possession of Marijuana, a misdemeanor.
Clovis Police responded to a call on June 16, 2017, where a female reported she had been shot in the head. The victim underwent surgery at a local hospital for gunshot wounds and other injuries, from which she eventually recovered. The suspect, Joshua Martinez, had fled the scene and was apprehended a short time later.
The Honorable Drew Tatum presided over the one-day trial and issued a material witness warrant for the victim who failed to appear to testify. Judge Tatum ordered that sentencing be held at a later date. Martinez could face up to 21 and one-half years in prison, the sentence being enhanced by eight years for prior felony convictions. The defendant is also pending trial on another domestic violence case that occurred in May of 2017.
