Rodriguez Sentenced in Aggravated Fleeing

May 15, 2017

Clovis NM – Ninth Judicial District Attorney, Andrea Reeb, announced that Cesar Rodriguez, age 36, of Clovis; was sentenced today by Ninth Judicial District Judge Matthew Chandler of Aggravated Fleeing a Law Enforcement Officer, a felony; Possession of a Controlled Substance, a felony; Resisting Arrest and Possession of Drug Paraphernalia, misdemeanors.  Rodriguez was sentenced to 21 years in the New Mexico Department of Corrections, which is the maximum possible penalty for these crimes.  Rodriguez had previously been convicted of three felonies, which enhanced the sentencing.

In August of 2016, a Clovis Police Officer attempted to stop Rodriguez for outstanding warrants, when Rodriguez sped off in his car, leading police on a high speed pursuit. Officers soon called off the pursuit due to rainy conditions and safety of the community. Rodriguez was later located and after resisting officers’ commands and being tazed was taken into custody. Drugs and paraphernalia were found after a search warrant was executed on Rodriguez’s vehicle.

Assistant District Attorney, Claire Adams, prosecuted the case for the State of New Mexico.
Criminal Defense Attorney Jonathan Miller, of Albuquerque, represented Rodriguez.
