Clovis NM – Ninth Judicial District Attorney, Andrea Reeb, announced that Jose Emiliano Lopez, age 25, of Clovis, was sentenced today before the Honorable Drew D. Tatum.
Lopez pleaded guilty in October of 2016 to sexually assaulting his three-year-old step-daughter. The girl’s mother took the child to the emergency room after she complained of pain in her private area and identified her “Tata” as the abuser. A sexual assault nurse exam showed injuries to the child consistent with sexual abuse.
Judge Tatum, upon announcing his sentence stated that the diagnostic evaluation completed by the Department of Corrections showed Lopez had no remorse for his actions. Judge Tatum stated, “You were a father figure to this 3-year-old child who is innocent, helpless and vulnerable. This is truly despicable, that you caused her a lifetime of pain and distrust. That is not forgivable. I have a duty to protect this community from sexual predators.” Judge Tatum sentenced Lopez to the maximum sentence of 30 years in the New Mexico Department of Corrections. Lopez will also be required to register as a sex offender for life and serve lifetime parole and 5 – 20 years of probation upon release from prison.
District Attorney Andrea Reeb prosecuted the case for the State and stated, “ The victim’s family was extremely pleased with this 30 year sentence. Judge Tatum sent a clear message to this community that those who chose to sexually victimize small children will not be tolerated and these predators will not be allowed to roam free in the 9th Judicial District. This 3-year-old and her family can now rest safe that the defendant will be in custody for a very long time.”
