Ninth Judicial District Attorney, Andrea Reeb, announced Johnathan Cruz, age 24, of Clovis, NM, had a preliminary hearing today in Magistrate Court on an open count of First Degree Murder. Magistrate Judge Richard Hollis presided over the hearing and found that, based on the evidence presented, there was probable cause that Cruz committed the crime and that the case should be bound over to District Court.
Joseph “Jo Jo” Chavez died from a stab wound during an altercation between several individuals on March 8, 2015 at 1000 Beta in Covis. Witnesses at the scene reported that a Hispanic male was holding a firearm and then a shot was heard. This followed by Chavez falling to the ground bleeding from the chest. Chavez was taken to Plains Regional Medical Center by private vehicle, where he was later pronounced deceased.
Investigators with the Major Crimes Unit later discovered Chavez had been stabbed by Cruz.
Chief Deputy District Attorney, Brian S. Stover, is prosecuting the case for the State of New Mexico. Cruz is represented by Criminal Defense Attorney, Anna M. Aragon, of Las Vegas, New Mexico. Cruz is being held in the Curry County Detention Center without bond and will be arraigned in District Court within the next two weeks.
